Cleethorpes cafe closes after owners refuse terms of lease
A CAFE in a Cleethorpes park has closed indefinitely after owners refused the council’s offer of a lease which required them to clean the toilets and was “not commercially viable”.
Haversnack, the cafe in Haverstoe Park, has closed as the owners have refused to accept the offer of a lease from North East Lincolnshire Council.
Former co-owner Mark Thomas said: “We enjoyed running the cafe but were running at a loss and hoped the council might take this into account when offering a new lease.
“However, they did not and wanted us to open, close and clean the toilets which would have required even more staff.

“My business partner and I are both local and users of the park but as much as we like it, we have had to walk away because it is just not commercially viable.”
A spokesman for NELC said that strategic partners Balfour Beatty will conduct an “informal tender exercise” to find a new occupier.
The spokesman added: “Expressions of interest will be invited by way of an informal tender exercise with interested parties asked to submit their offers in writing. It will be a part of any lease agreement that the operator of the café is responsible for the toilets within the building which will include their opening and closing, cleaning, security and so on.
“Any potential operator will therefore be expected to undertake their own due diligence as to the viability of the proposal and rent they are prepared to tender.”

“Whose been cleanings toilets for the past 18 months? This was already part of the contract, the reason it's closing is the overpriced ice creams two for a fiver! Stupid opening hours and alienating the bowls club who had used the building for over 25 years! Great business sense.”

I've seen information requests put to the council turned down on the grounds that the information relates its contractor so is not held by the authority. They further state that its contractor has no obligation under the Freedom of Information Act to supply information so is therefore exempt.
One wonders then, why North East Lincolnshire Council has this detailed in its contract between itself and an the contractor providing outsourced service:
"3.58 *********** understands and acknowledges the Council is subject to the requirements of the Freedom of Information Act 2000 and agrees to assist and co-operate with the Council to enable it to comply fully with its disclosure obligations including supplying requested information within 48 hours of being asked to do so by the council."”
