A 12-YEAR-OLD boy who was fined after he vomited in the street is at the centre of the latest community wardens row.

Bradley Brooks was stopped and fined by wardens because he put a plastic drinks bottle on a green telephone communication box while being sick.

The Matthew Humberstone School pupil was walking along Westward Ho, in Grimsby, when he began to feel ill.

It is the latest in a number of incidents which has led to questions being asked by Telegraph readers about the value of wardens to the community.

Bradley had been at a friend's birthday party on Sunday at about 4.30pm when he decided to walk home as he was feeling poorly.

Bradley was fined by community wardens after he was sick in the street.

He said: "I was sick on the road and then the wardens stopped me further on. I had sick on the bottle so I put it on top of what I thought was a bin. Then the wardens stopped me.

"I thought they were going to ask me if I needed any help but instead they fined me and kept me there for half an hour while they told me I would be fined or have to do community service."

A spokesman for North East Lincolnshire Council said: "Our community wardens acted properly in this case. They saw Bradley put down his bottle and walk a considerable distance before they approached him. At that point he said he felt a bit sick but there was no sign of any illness.

"Bradley has been offered the chance to take part in a litter-pick and environmental education day in lieu of a £50 fine.

"There is a very effective appeals process should his family wish to take the case to court."

But Bradley's mother, Sarah Tuson, of Milton Road, Grimsby, said: "It's a disgrace. I haven't brought my kids up to litter and to pick on a sick child is not acceptable.

"These people get paid good money to represent our community and all they do is pick on a decent lad who wasn't very well. He couldn't find a bin, so he put it on top of the electricity box. He was terrified."

Coun Norma Lincoln (Labour, South ward) added: "I am annoyed that the wardens said he wasn't sick. I saw Bradley and Sarah after he had arrived home and saw the vomit myself on Westward Ho. I can't believe it."

Bradley is currently awaiting his fixed penalty notice.

    “I saw a warden stop and fine a gentleman in the town centre for dropping and stamping out his cigarette end. They were right in stopping him. The man then offered to pick the cigarette end up and put it in the bin. They would not let him; told him to leave it and wrote him an FPN. After the guy had walked off not best pleased I observed the scene. The wardens left the cigarette on the floor and walked on to look for their next victim and further revenue.. I then picked up the cigarette end and put it in the bin.
    In this instance - and this has probably happened more times - the wardens created litter.
    Could they honestly say that the man would not have picked it up and binned the fag end himself? He had only that sceond stamped it out. Did they expect him to put it out with his tongue or his fingers? His next step may have been to pick it up and then find a bin.
    Personally, I doubt he would have done, and probably would have just left the fag end on the floor. But there's a chance that he wouldn't have. And he offered to pick it up and put it in the bin.

    In Bradley's case though, he does seem to have littered. Whether he thought something was a bin or not - you don't leave litter on top of a bin, you put it in it. He broke the law, end of. He was unlucky to get caught, but rightly punished. The lack of compassion is a seperate issue. From what I have witnessed as a right-nosey-parker I would not be surprised if the wardens did go about it the wrong way. They should have been concerned for the boy's welfare first and foremost. Then fined him. Either way, he was 12, his mother should have been informed immediately. He probably shouldn't even have been walking the streets on his own. The wardens should have acted on this.”

    “It amazes me how many comments such a story can create. I think the Evening Telegraph realise this, and rather than investigating the facts they give you just enough to jump to conclusions. If I ran this website I would seriously consider making users register before posting comments, as on many of the stories publishes on here there are comments which could easily be considered as libelous. As for the matter in hand - Do these wardens actually have the right to detain anybody? As long as contact details are given, the wardens should then be able to issue a penalty notice.”

    “When was the last time YOU actually saw a street cleaner actually sweeping the streets, Nadia, grimsby?

    I used to live in the Mill Rd, area, and I never saw one in that area, including St. Peters Ave, for at least the last two years I lived there. And that was over three years ago. I also cannot remember when was the last time I saw anyone cleaning Victoria St. of litter, either.

    I don't drop litter in the streets, nor do I own a dog or any other animals/pets.
    And I have not fallen for the "Telegraph's "sensationalism, as I have aired my views long before this story.

    Do NELC still employ street sweeper's/cleaners with a brush and cart now?

    The warden's don't go out at night because they are scared to pick on lads of 18 -30 at a week end. Just like the useless PCSOs.

    As I have said, issuing a ticket doe's not remove the litter, a brush and shovel doe's.”

    “there isn't a green box in the picture because its behind me on the next block.....Bradley was walking up Westward Ho from town on his way home.....
    so he was sick before the green box and before the wardens stopped him....
    I have been reading all the comments this weekend and find it interesting...
    i for one have never had any dealings with these wardens before,but have seen them in the paper for the rubbish clearing they do ect...also read other stories that weren't so good too........
    so you see i don't think there all bad I'm saying
    My 12yr son was stopped after being unwell (to look at him anyone could see he was ill) he asked please could he go home as i feel very sick and the wardens said no !!!! and kept him 30mins filling out forms ect
    to me this was wrong ....as he told them he was ill and i didn't even get a phone call nothing
    Also the wardens had followed him from Abbey road and past him a few times as they went round the block just waiting for my son to do something wrong it seems
    they also called him a liar and said he wasn't sick...and that he was just saying that to get way without a fine
    there was no compassion !!!!and at the time ,Bradley did say i will show you i was ill but no just was little Hitlers and read him the riot act
    And as for me going to the papers with this story i thought people should no and be aware!!!....also I'm not a pushy mum and this was also Bradley choice too”

    “Its pretty clear that theres no NTL box in the picture near the sick, maybe the lad felt a bit unwell AFTER receiving his ticket. As for community wardens they do more than just fine, they've helped clean my alley of rubbish with rats in and graffiti off. Its amusing that some people would expect these wardens without any protective gear or self defence equipment to go fining on weekend night times, i say.........would any of you??”

    “you sound confused .
    let me explain
    community wardens are not police officers; they are as the name would suggest community wardens
    police officers wear black clothing,sometimes a helmet and they enforce all aspect of the law. it is however, highly unlikely you would see them issuing FPN's for littering/dog fouling. that's what community wardens do [among many other things so i understand]
    road sweepers are Road sweepers they do not have any enforcement powers. so wardens dont do that job because someone else is employed to do it.
    furthermore walking the streets at night in Cleethorpes & Grimsby on a Friday , Saturday night is a job for the police because its dangerous and that why the police do it. I know its complicated and difficult to understand ,yourself included apparently.
    hope this helps clears this up for you and now you know who supposed to be doing what”

    When do you ever see these so called police officers walking the streets at night in Cleethorpes & Grimsby on a Friday , Saturday night handing out Fixed Penalty Notices to gangs of people stood outside pubs dropping the tab ends on the floor walking around the market place where people are being sick all over the streets dropping rubbish on the floor.
    Or do they just pick on the easy targets???????

    “My my what tall stories people tell to try to get out of paying for what they have done. its laughable. All those readers who say that wardens are a waste of money fall hook line and sinker for The Evening Telegraphs Sensationalism or have had the misfortune of being caught not picking up after their dog or littering our streets. Grimsby is a real state; we have to suffer Massively from foul mouthed idiots everywhere ,litter louts and ASB. wardens are employed quite simply to try to make this a better place for us ALL to live in. i guess you'd prefer to live in Ghettos,in fear and living in our own rubbish.
    And The evening Telegraph? you should ashamed of putting this rubbish on your front page! there are far more pressing concerns . dont you think?”
