Council considering legal powers to stop sale of cars at roadside in North East Lincolnshire

THE council will consider a range of legal powers to prevent cars for sale being parked on the roadside.

It comes less than two months after it abandoned plans to impose a two-hour waiting restriction along Grimsby Road, in Cleethorpes, to deal with the problem.

Instead the council will seek to use the Clean Neighbourhoods Act or section 147A of the Highways Act to prevent parking spaces being taken up for long periods by vehicles for sale.

The former outlaws the sale of two or more vehicles within 500 metres of each other; the latter makes it illegal to offer for sale any item on the verge of a trunk or principal road.

Council lawyer Dick Marshall said the "draconian measure" of control orders would be considered as a last resort if these options were unsuccessful.

He told a Regeneration and Environment Scrutiny Panel meeting that the authority had decided against introducing a new byelaw, as it would be "inappropriate" where legislation already existed.

Head of development, Jason Longhurst, said the move represented a "step away from looking at traffic regulation orders".

As reported, portfolio holder Peter Wheatley agreed to impose a two-hour waiting limit along Grimsby Road in response to a petition demanding action to stop cars for sale parking along the roadside.

However, after objections from residents who would have been affected by the blanket restriction, the council decided to drop the order before it was even imposed.

Councillor Philip Jackson (Con, Waltham) said he was pleased the council had abandoned the idea of uniform parking restrictions along Grimsby Road.

He accused the Labour administration of performing a "massive U-turn on a measure that was never going to work" after previously claiming they had resolved the issue.

He referred to November's full council meeting at which council leader Chris Shaw taunted his opponents for failing to tackle the problem during their eight years in charge because they "couldn't seem to get their little heads around it".

Councillor Jackson said: "I'm pleased that we've abandoned the idea of the uniform parking restrictions on Grimsby Road, but we certainly haven't solved the problem as the leader of the council said a couple of full councils ago."

Councillor Wheatley replied: "If something has never been implemented I can't see how you can do a u-turn."

    “well there is an easy solution, youths of today are bored.........they want to do acts of vandalism to avoid this............. hello children, instead of damaging the family cars look for the ones that have the for sale signs that will put a stop to it.

    “FYI, I have nothing to do with selling cars. I do live in the vicinity and have done for a long time. They are no big deal. I will guess it is the queen of Daubney St. who kicked all this off. The longer this farce goes on the more attention it draws. Then you will get others placing vehicles here and exasberate things.”

    “The council can do what it likes and considers best for the problem. However with everything like this it comes down to enforcement. Having survived yet another near miss can anyone tell me whether the bus lanes on Scartho Road are to be removed or will there actually be any enforcement of them. You can have as many laws. regulations and rules as you like but if they are not enforced the law falls into disrepute and will be totally ignored. As a dutiful driver I try and comply with the bus lane rules but if you do, well, a very dangerous thing to when far more important people race up on the inside at 60 mph and when you try and move over at the appropriate point, well ..................”
